These Terms of Use (“Terms”) govern your access to and use of the website, mobile applications, and online services operated by RedPeak Ledger (collectively, the “Services”). By accessing or using the Services, you agree to be bound by these Terms, our Privacy Notice, and any applicable account agreements. If you do not agree, please do not use the Services.

1. Eligibility

To open an account or use most features of the Services, you must be at least 18 years of age, a resident of a jurisdiction where we offer Services, and provide accurate and complete information during registration. We may, at our sole discretion, refuse to provide Services to any person or entity.

2. Account security

You are responsible for maintaining the confidentiality of your login credentials, account number, and any device you use to access the Services. Notify us immediately through your online banking inbox if you suspect unauthorized access. RedPeak Ledger will never ask you for your full password, PIN, one-time code, government tax identifier, or full debit- or credit-card number by phone, email, or text message.

3. Acceptable use

You agree not to use the Services for any unlawful purpose, to attempt to gain unauthorized access to any portion of the Services, to interfere with the security of the Services, or to use the Services in any manner that could damage, disable, overburden, or impair our infrastructure. Automated scraping, probing, or scanning is prohibited without prior written consent.

4. Account communications

By providing your email address and phone number, you consent to receive electronic communications from us related to your accounts, including statements, fraud alerts, security notifications, and required disclosures. You may opt out of marketing communications at any time without affecting service-related messages.

5. Funds availability and processing

Deposits are subject to our Funds Availability Policy. Transfer requests submitted before the daily cutoff time will be processed on the same business day; requests received after the cutoff or on non-business days will be processed the next business day. Crypto deposits require on-chain confirmation before funds are credited to your account.

6. Fees

Account fees are disclosed in our Fee Schedule, which is provided at account opening and available upon request. We will provide at least 30 days’ advance notice of any changes to fees on existing accounts.

7. Disputes and error resolution

If you believe there is an error on your account or a transaction you did not authorize, contact us immediately through your online banking inbox. Applicable law limits your liability for unauthorized electronic fund transfers, provided you notify us within the timeframes described in our Account Agreement.

8. Intellectual property

All content on the Services, including text, graphics, logos, icons, images, and software, is the property of RedPeak Ledger or its licensors and is protected by applicable copyright laws.

9. Disclaimer of warranties

The Services are provided “as is” and “as available” without warranties of any kind, either express or implied, including without limitation warranties of merchantability or fitness for a particular purpose. We do not warrant that the Services will be uninterrupted or error-free.

10. Limitation of liability

To the maximum extent permitted by law, RedPeak Ledger shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Services.

11. Governing law

These Terms are governed by the laws of the jurisdiction in which RedPeak Ledger is organized, without regard to its conflict-of-laws principles. Any dispute arising under these Terms shall be resolved in the competent courts of that jurisdiction.

12. Changes to these Terms

We may update these Terms from time to time. The “Last updated” date at the top of this page reflects when the most recent changes took effect. Continued use of the Services after a change constitutes acceptance of the updated Terms.
